KATE
Kate had been losing consciousness and any hopes of living along with it. She was giving up the fight. Then Jack came in and Kate's will to hang on and fight was back in full force. As soon as Jack had pried Ed's hands off her neck, Kate sucked in a deep breath and crawled away backward until she came up against the tent. She took in huge gulps of air between coughs. The lightheaded feeling was slowly receding and with her attention off the fact that she couldn't breath, the pain on both the outside and inside of her throat was coming to the surface. Kate watched as Jack tried to get the marshal under control. She thought her presence was forgotten until Jack turned to her.
"What did you do?"
Kate looked at him in surprise. What did she do? "I was just checking to see if he was--" Another coughing fit overtook her. Her voice was weak and raspy and it sounded strange to her own ears. Once again, she spoke in a quiet, raspy voice, trying to defend herself. "He jumped on me. He grabbed me." She looked at the marshal who was currently unresponsive. "Is he ... okay?" she asked with concern in her voice. Why she was still concerned, she did not know. Maybe because she felt they had some kind of history. Maybe it was also the fact that it was ingrained in her to cover all tracks and not showing concern for the wellbeing of someone who's supposed to be a stranger might raise some questions. Yes, the man had just tried to kill her so the only logical excuse she could think of, if she needed to try to explain further, was that it was a temporary lapse of sanity due to the fever.

JACK
Jack, while still trying to calm the marshal into a comforted state, responds based on what he knows, although his response seems more angered then needed, but anger would make sense given the situation. "He's not responding to any antibiotics, he's bleeding internally, his fever's pushing a hundred and four, and his abdomen's rigid," he responded making it sound like Kate didn't actually care... "He needs water."

You didn't have to be a doctor to know that what Jack described as the symptoms were bad. Kate watched in surprise as he just stormed out of the tent and left her there. He seemed so angry at her and almost detached. She was confused and stormed after him.
***follows Jack outside of tent into pouring rain and gets immediately drenched***
"So what are you going to do about it?" she shouted above the sound of rain. "About him," she clarified, gesturing toward the tent. There was no point in dancing around the issue. Everyone on the camp knew the fate of the man in the tent. He'd been keeping everyone on edge with his moans of pain. "Will he suffer? Will it be quick?"

"No, it won't be quick. Two, three, maybe four days," Jack replied in anger. His rage and frustration building inside of him like a shaken bottle of pop. "...He'll feel it."

She paused a moment in thought. Nobody deserved to die like that, not even after what he'd put her through, not that she blamed him for doing his job. She'd always harbor a resentment toward him for not agreeing to stop his chase after she pleaded with him, wanting to start a new life with Kevin. But again, it was her fault for getting so close to someone.
Finally, she voiced what everyone on the beach who'd had to listen to the marshal had been thinking. "Can't you put him out of his misery?"

Jack stopped mid step. He hoped he could have avoided the whole problem, that maybe Kate wasn't all that bad, perhaps she had just made some bad choices, but now, with her almost literally asking Jack to kill the marshal, that's where Jack had to draw the line. Jack turned around and marched towards Kate with anger and grief glaring in his eyes, "I saw your mug shot, Kate. I am not a murderer," Jack walked back into the tent.

Kate stood there, unmoving and unable to talk from the shock. He walked away and she didn't follow. He knew. That entire time, he knew. How long has he known, she wondered? She suddenly felt very much alone and ashamed and like she lost the only person she'd connected with in so long besides Kevin.
She hung her head down, oblivious to the drenching rain, feeling lost.

Jack kneeled next to the marshal. He took out a cloth and soaked it in water. He queezed the cloth over the marshal's mouth to allow him to drink.

((OOC: I hope you guys don't mind that I'm quickly posting some of what the marshal says so we can jump ahead to the end of the Marshall/Jack convo all in one more Jack post before he goes to find Kate))
MARSHAL
He had to concentrate on what used to be an easy task as he drank the offered water. "Listen to me --" he started coughing as he had still been in the process of swallowing when he began speaking. "Listen to me. No matter what she does, no matter how she makes you feel, just don't ... trust a word that she says. She will do anything to get away." He ignored Jack's attempts at an interruption as he was hell bent on getting his way before it was too late for him. "I want to talk to her. I want to talk to her alone." The Marshal saw Jack's hesitation and snickered. "She got to you, too, huh?"
KATE
**arrives from F3 Area of Survivor Camp**
Kate stood outside the tent, the night breeze swaying the tent flap giving her a small peak at what was going on inside. Jack was trying to calm the marshal and the marshal kept insisting on seeing her, alone, no less. Was he planning on making another attempt to take her out before he was gone? She decided to play it safe and moved a bit further away from the tent and stood near one of the fires as if she hadn't had the intention of seeing the marshal just moments ago. She stood at an angle as if looking out to shore but watched the tent in the corner of her eye.

"She got to you, too, huh?"
Jack stopped. He knew that was the case, he just didn't want to believe. He has hoped that their, his and Kate's, connection was real, but Jack knew she was probably just playing him. Jack was motionless as he considered the marshal's request. He pause in thought. He then stood up and walked out of the tent. He seemed to have figured that Kate wouldn't do anything, and that the marshal was to weak to attack her again. Jack inhaled as he felt the quite breeze on his neck, "Kate," he said as he stepped out of the tent. Jack hadn't really known she was waiting outside the tent, but it came as no surprise to him. "He wants to talk to you..." Jack paused, "alone."

She turned to look at Jack when he called her name. Of course she'd been watching from the corner of her eye and had seen him leave the tent but she didn't act as if she was expecting him nor did she act surprised. She simply watched him as he spoke.
The marshal wanted to talk to her alone? That solved her problem of how to get in there. "Okay," she said after a few moments of looking as if she was contemplating what she would do. Without another word, Kate walked past Jack and into the tent.
MARSHAL
He watched her enter. "What was it?"
KATE
She shook her head in confusion. "What?"
MARSHAL
"The favor."
KATE
"I don't know what you're talking about." In all honesty, she didn't.
MARSHAL
"Last thing I heard before the crash, you wanted a favor." He watched Kate closely as she seemed to be lost in thought. "Well?"
KATE
She'd looked away as she remembered the time that she'd spent living under Ray's roof up until the time he'd also betrayed her. Everyone eventually did. Kate looked back at Edward. "I wanted you to make sure that Ray Mullen got his twenty-three grand."
MARSHAL
The Marshal starts chuckling resulting in a coughing fit. He watched as Kate knelt down beside him with a concerned expression on her face. He just couldn't figure her out; someone who kills a man, her own father, in cold blood, cared not only about the guy who'd ratted her out but was concern about him; the man who'd made her life a living hell. Still, he had to confirm it. "What, the guy who ratted you out?"
KATE
"He had a hell of a mortgage," she said with a wry smile.
MARSHAL
"Kate. You really are one of a kind." If he'd had the strength, he would have shook his head at her. "You know, you would have got away if you hadn't saved him."
KATE
He was still trying to win and it bothered her. She wanted to rub that smug look off his face, so she said, "In case you hadn't noticed, I did get away."
MARSHAL
He'd expected such an answer and quickly added a rebuttal. "You don't look free to me." He gave a self-satisfied smirk as she looked away, having been affected by what he said. He started coughing again which sent pain throughout his body. He gave up on trying to save his pride by acting as if he would beat this thing. "Kate, I'm gonna die, right?"
KATE
She stared at him, then finally nodded. "Yeah," she said quietly.
MARSHAL
"So ..." he coughed, "are you gonna do it, or what?"
KATE
She discussed with Edward that there was someone else who had volunteered for the job. It was for the best for two reasons; Kate couldn't get herself to do it, which she did not tell him because he'd have laughed, and second, being taken out by the person you'd dedicated years to take out was not the way any person would want to leave this world.
Kate looked out of the tent flap at Sawyer giving him the signal they'd agree on for when she was ready for him to do what had to be done.

Jack stood outside the tent staring at the ocean. It was almost mesmerizing, like he could clear all his thoughts and just fade out. He watched as the waves gently brushed up along the shore line, surrounded by the calm, settling night.

HURLEY
Since everyone was getting anxious about the death rattles coming from Jack's tent, Hurley decided to check in with the doctor and see if he could get some good news to maybe spread around the camp and calm people down.
"Yo," he greeted Jack, walking up to him as he stood outside the tent. "So...where's the fugitive?" he asked, preferring to deal with one crisis at a time. He felt a little guilty for hurrying off like the Road Runner when he'd met up with Kate earlier but still, better safe than sorry.

He entered the tent and saw the marshal lying down, clearly in pain. The marshal looked at him curiously, but when Sawyer drew the gun from the back of his jeans, he understood. "You ready for this?" he asked.

He glared up at the newcomer through his blurred vision, his eyes wide. He gave a nod, and then closed them tightly.

SAWYER
Sawyer stepped to the side of the marshal and placed the barrel of the gun to his chest, right above the heart. He took a steadying breath and pulled the trigger. The loud bang of the shot going off echoed through the tent. Then, with a look at Kate to make sure she was okay, he put the gun back in his jeans and walked out of the tent.

As Sawyer was getting ready to shoot the marshal, Kate turned and started walking out of the tent. She just couldn't watch and was several feet away when the shot rang out.

((ooc: Okay Heidi, I'm gunna take your advise and just post the transcript, I'd do a proper post, but I have literally no time, and it seems you guys really want to get day 4 done with... Gee who'd have thought?
JACK
"In the tent."
HURLEY
"You let her in there alone?"
JACK
"What's she gonna do? She's a hundred and twenty pounds soaking wet."
HURLEY
"Yeah, but she's got that gun."
JACK
"What?"
Jack turned and ran back to the tent.
HURLEY
"She's strapped, man. I saw it in her -- in her -- in her -- in her --"
Just before he could get there, he stopped when he saw Kate leaving.
JACK
"Kate!"
Kate turned and looked back at Jack. The gun fired. It startled Jack. Kate didn't seem startled. She turned away and continued to walk away.
Jack watched as Sawyer walked out of the tent, "What did you do?" he asked in utter anger.

NARRATION
Jack and Sawyer continue to argue until suddenly, coughing and sputtering can be heard coming from the tent. Sawyer's aim was not the killing shot he'd thought it was. Everyone nearby is stunned and horrified. After Jack gives Sawyer a verbal bashing, Jack goes into the tent, silencing the marshal, Edward Mars, for good.
